These terms are a contract between you and the operator of Call & Translate (“we”, “us”) for use of callandtranslate.com and the related app. If you do not agree, do not use the service.
1. Agreement
By creating an account, ticking the acceptance box, paying, or using the service, you agree to these Terms, the Acceptable Use Policy, and the Privacy Policy. If you use the service for an organisation, you confirm you have authority to bind it.
You must be 18 or over. The service is not directed at children.
2. The service
Call & Translate is a speakerphone voice agent. You brief it, place a call yourself, put the phone on speaker, and the agent speaks another language while you follow a live transcript. We may change, suspend, or discontinue features. We do not promise uninterrupted or error-free operation.
You place the telephone call. We do not operate as a phone carrier, interpreter-for-hire, law firm, medical service, or emergency service. Do not use the product for emergencies. If someone is in danger, use local emergency numbers.
3. Calls involving other people
You are the caller. You are responsible for every call you make with the product, including what is said in your language and what the agent says in theirs.
- You must have the right to call that number and to involve an AI assistant on the line.
- You must comply with all laws on telecommunications, marketing calls, spam, recording, and transcription — including two-party consent rules where they apply, PECR in the UK, and similar rules in other countries (for example the US TCPA).
- You should disclose that an AI assistant is on speakerphone whenever the law, the other person, or basic fairness requires it. The product can say this for you; switching that off does not remove your duty.
- You must not use the service to harass, defraud, impersonate, or collect information from people who have not agreed to deal with you.
The other person is not our customer. We have no contract with them. You indemnify us for claims that arise from your calls, your brief, or your failure to get any consent the law requires.
4. AI, translation, and transcripts
Speech recognition, translation, voice, and summaries are produced by automated models (including xAI). They can be incomplete, late, biased, or wrong. Names, numbers, prices, dates, medical or legal terms, and tone are often misheard. You must check anything that matters before you rely on it.
We do not warrant that a translation is accurate, that a summary is complete, or that a call will achieve the outcome in your brief. The service is a tool. You remain responsible for the conversation.
5. Accounts and security
Keep your password, passkeys, and devices under your control. Tell us if you think the account is compromised. We may refuse a name or email, require verification, and close accounts that look abusive or automated.
You can schedule deletion in Settings. Deletion is completed after a 24-hour window, subject to records we must keep by law. We may suspend or close an account that breaks these terms or the Acceptable Use Policy.
6. Credits, subscriptions, and refunds
Free accounts can use the app without live calling until credits are granted. Paid is billed as described on the pricing page (currently £12 per month for 3,600 seconds of call time, plus optional extra-hour top-ups). Credits are call seconds. They expire 30 days after they are added. Unused credits are not a cash balance.
Prices include VAT if we are required to charge it. Payment is processed by Stripe. By paying you also agree to Stripe’s terms.
Consumers in the UK or EEA: you may have 14 days to cancel a distance contract. If you ask us to start a paid digital service immediately (for example by completing checkout for call time that is delivered at once, or by using the paid service), you acknowledge that you lose the right to cancel that digital content once performance has begun, except where the law still gives you a remedy. Statutory rights for faulty digital content still apply. We do not otherwise refund unused credits.
Subscriptions renew until you cancel through the billing portal or by asking us. Cancelling at period end stops the next renewal; remaining time in the current period still expires on its stated date.
7. Acceptable use
You must follow the Acceptable Use Policy. In short: no illegal use, no spam or unsolicited calling that breaks the law, no harassment, no impersonation to deceive, no attempts to break or overload the service, and no use that would make us a party to someone else’s harm.
8. Your content and our IP
You keep whatever rights you have in briefs, transcripts, and other content you submit. You grant us a worldwide licence to host, process, transmit, and display that content only as needed to provide the service (including sending it to subprocessors such as xAI and Stripe).
The product, name, design, and software are ours or our licensors’. You may not copy, scrape, reverse engineer, or resell the service except as the law allows.
9. Privacy
How we handle personal data is explained in the Privacy Policy and Cookie Policy. You must not put other people’s personal data into a brief or onto a call unless you have a lawful reason.
10. Disclaimer of warranties
The service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not warrant that calls will connect, that the other person will cooperate, or that a translation will be fit for professional, medical, or legal use.
Nothing in these terms takes away rights you have as a consumer that cannot be waived, including under the Consumer Rights Act 2015.
11. Limitation of liability
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that English law does not allow us to limit.
Subject to that paragraph, we are not liable for:
- loss of profits, revenue, business, goodwill, or data;
- indirect, incidental, special, or consequential loss;
- inaccurate transcription, translation, or summaries;
- the outcome of any call, booking, purchase, or negotiation;
- acts of the person you call, of you, or of third-party processors;
- your failure to comply with recording, privacy, or telecommunications law;
- unavailability, delays, or faults outside our reasonable control.
Our total liability for all claims arising out of the service is limited to the greater of £12 or the amount you paid us for the service in the 12 months before the claim.
12. Indemnity
You will indemnify and hold us harmless from claims, losses, and reasonable legal costs arising from your use of the service, your content, your calls, your breach of these terms or the Acceptable Use Policy, or your infringement of someone else’s rights — except to the extent we caused the loss by our own fraud or negligence that the law does not let us exclude.
13. Suspension and termination
You may stop using the service and delete your account. We may suspend or terminate access if you break these terms, if we have to for legal reasons, or if we shut the product down. Sections that should survive (including 3, 4, 8, 10–12, 14, and 15) remain in force.
14. Changes
We may update these terms. The date at the top will change. For a material change we will give reasonable notice on the site or by email. If you continue to use the service after the change takes effect, the new terms apply. If you do not agree, stop using the service and delete your account.
15. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also bring proceedings in your country of residence if the law gives you that right.
If a court finds one part unenforceable, the rest still applies. These terms are the entire agreement for the service and replace earlier versions. We may assign the contract in a sale of the business. You may not assign it without our consent.
